Terms of Service

1. Acceptance of Terms

By creating an account or using UptimeWarrior, you agree to these Terms of Service. When you register we ask you to agree to them and to our Privacy Policy, and we record when you did. If you do not agree, do not use the service.

2. Description of Service

UptimeWarrior monitors the websites you choose: whether they are up and how fast they answer, their TLS certificates, domain expiry, broken links and page meta tags. It sends alerts when something goes wrong, and offers weekly reports and public status pages. What each plan includes is on our pricing page.

3. Account Registration

You must provide a valid email address to register, and we allow one account per mailbox. There is no password: you sign in with a single-use code sent to that address, so you are responsible for keeping access to that mailbox secure, and for all activity that occurs under your account. Notify us immediately if you suspect unauthorised access.

4. Acceptable Use

You may only monitor URLs and systems you own or have explicit permission to monitor. You must not use UptimeWarrior to:

  • Monitor systems without authorisation from the system owner.
  • Generate excessive or abusive traffic toward monitored endpoints.
  • Circumvent, disable, or interfere with security features of the service.
  • Violate any applicable law or regulation.

We reserve the right to suspend or terminate accounts that violate these rules.

5. Billing and Subscriptions

Paid plans are subscriptions. By subscribing to a paid plan you authorise us to charge your payment method each month, as described below.

  • Price: each paid plan has a monthly minimum, which covers a set number of sites, and a price per site for every site above that. Some plans charge a lower rate for sites above a certain number. The current figures are on our pricing page.
  • What is counted: you are billed for the highest number of active sites on your account during the billing period. Paused sites are not counted, but a site that was active at any point in a period counts for that whole period: pausing or deleting it lowers what later periods count, not the current one.
  • Invoicing: monthly, in arrears. Each invoice covers the billing period that has just ended.
  • Trials: a new paid account starts with a free trial of 14 days. You give card details when you sign up, and when the trial ends Stripe charges that card automatically unless you have cancelled.
  • Changing plan: an upgrade takes effect immediately, and the whole current billing period is billed at the new plan's rates. A downgrade takes effect at the end of the current billing period.
  • Cancellation: you may cancel at any time from the Billing page in your account, which opens Stripe's billing portal. Cancellation takes effect at the end of the current billing period, and monitoring continues until then. No partial refunds are issued for unused time unless required by law.
  • Price changes: we will email the account's email address at least 30 days before changing subscription prices. Continued use after that date constitutes acceptance of the new price.
  • Who sells the subscription: paid plans are sold through Link, Stripe's merchant of record service. When you subscribe, you pay Link: you enter your name, billing address and payment details on Stripe's checkout page, Link charges you, and your receipts and invoices come from Link.
  • VAT: prices exclude VAT. Link calculates the VAT that applies from your billing address and adds it to what you are charged.
  • Payment questions and refunds: Link handles questions about a payment, and you can manage or cancel your subscription on Link's website as well as from the Billing page. Link may refund a payment within 60 days in some cases under its own terms.
  • Payment processing: payment details are entered on Stripe's own pages and never reach our servers.

6. Free Plan and Trials

The Free plan needs no card and covers up to 3 sites. It stays free for as long as the account is used:

  • If nobody on the account signs in or uses the dashboard for 60 days, we email the account's email address to say monitoring will pause.
  • Monitoring pauses once the account has gone 74 days without a visit, and never sooner than 14 days after that email. Status pages stay up and say that monitoring is paused.
  • At 180 days without a visit we request deletion of the account, which starts the 30-day window described in section 11.
  • Signing in at any point before the account is erased undoes each of these steps.

This applies only to the Free plan: paid accounts are never paused or deleted for being unused. We may end free accounts that are used to abuse the service, including by opening several accounts to get around the site limit.

A free trial of a paid plan is meant for new customers. We allow one account per mailbox, and addresses that differ only by a "+tag", or on Gmail by dots, count as the same mailbox. We may refuse a trial to anyone who has already had one. We reserve the right to end or modify free trial terms at any time.

6a. Public Free Scan

The free website check is offered without an account, as a single one-off scan. By submitting an address you confirm that you own that website or have the permission of its owner to have it checked, and you accept responsibility for that confirmation.

A scan requests the page at that address, connects to the site to read its TLS certificate, looks the domain up at its registry's RDAP or WHOIS servers, and requests up to 25 of the links found on the page, identifying itself as UptimeWarrior throughout. It is rate limited per requester and per target domain; we may refuse, throttle or withdraw it at any time. We do not store scan results. If a scan is refused or fails, the address submitted may appear in our application logs.

7. Service Availability

We aim to keep UptimeWarrior available and reliable, but we do not guarantee uninterrupted or error-free operation. Scheduled maintenance, third-party infrastructure issues, or events outside our control may cause downtime. Where we plan maintenance that we expect to interrupt the service, we will try to tell you in advance by email to the account's email address.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

  • UptimeWarrior is provided "as is" and "as available" without warranties of any kind, express or implied.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the service, including but not limited to lost profits, data loss, or business interruption.
  • Our total aggregate liability to you for any claim arising out of or related to these terms or the service shall not exceed the amount you paid us in the 12 months preceding the claim.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so the above may not apply to you in full.

9. Indemnification

You agree to indemnify and hold UptimeWarrior and its operators harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the service, your violation of these terms, or your violation of any third-party rights.

10. Data and Privacy

Our collection and use of personal data is described in our Privacy Policy, which forms part of these Terms of Service.

11. Termination

The account owner can delete the account at any time, from account settings. For billing, deleting the account is cancelling it: monitoring stops immediately, and the subscription ends at the end of the current billing period, which is billed as usual, including the monthly minimum and the sites monitored in it. Nothing after that period is charged. For 30 days the owner can undo the deletion, and everything returns as it was; undoing before the billing period ends also keeps the subscription, and after it ends monitoring restarts once the owner subscribes again. After 30 days the account and its data are erased (or, when the billing period ends within 2 days after that, once it has ended and been billed), and the customer record at Stripe is then deleted. Invoices already issued remain with Stripe.

If you were invited to someone else's account and do not own an account yourself, you can delete your own login from account settings.

We may suspend or terminate your account if you breach these terms or if we discontinue the service, with reasonable notice where practicable. Upon termination, your data will be deleted in accordance with our Privacy Policy.

12. Changes to These Terms

We may update these terms from time to time. We will email material changes to the email address of each account at least 14 days before they take effect. Continued use of the service after that date constitutes acceptance of the updated terms.

13. Governing Law

These terms are governed by the laws of the Netherlands. Any disputes shall be subject to the exclusive jurisdiction of the courts of the Netherlands, unless mandatory consumer protection law in your country of residence provides otherwise.
